Routine enquiry: 12 months from the filing deadline. Careless behaviour: up to 6 years. Deliberate behaviour (concealment): up to 20 years. Offshore income: up to 12 years. Unfiled returns: no time limit — HMRC can assess at any point.
Penalties range from 0–100% of unpaid tax depending on behaviour: careless errors 0–30%, deliberate errors 20–70%, deliberate and concealed 30–100%. Cooperating fully, making an unprompted disclosure, and providing complete information all significantly reduce the final penalty. We negotiate penalty classifications as standard.
COP9 (Code of Practice 9) is HMRC’s most serious investigation type, used where fraud is suspected. It comes with an offer of the Contractual Disclosure Facility (CDF): HMRC agrees not to pursue criminal prosecution in exchange for a complete and honest disclosure. Rejecting the CDF or making an incomplete disclosure exposes you to criminal investigation.
